Terms of Service
These Terms govern your use of the ChartlessOps platform (the “Service”), operated by ChartlessOps B.V., a Dutch private limited company registered with the Dutch Chamber of Commerce (KvK) under number 79482103 (“ChartlessOps”, “we”, “us”). By creating an account or using the Service, you (“Customer”) agree to these Terms.
01 Acceptance
You accept these Terms by creating an account, configuring a workspace, or otherwise using the Service. If you accept on behalf of an organisation, you represent that you have authority to do so.
02 The Service
ChartlessOps provides a browser-based opinionated signal panel that pulls from your existing metrics infrastructure. The available features, service limits, integrations, and storage are published at /pricing and in the documentation. We may add, remove, or change features. Material changes affecting paid plans will be communicated at least 30 days in advance.
03 Accounts
You are responsible for keeping your account credentials secure. Notify us at security@chartlessops.com if you suspect unauthorised access. We log all administrative actions on your workspace and surface those logs to you (Enterprise plan by default; on request for Growth).
04 Acceptable use
You may not use the Service to:
- send unsolicited bulk communication via our alert routing;
- host content that is unlawful in the Netherlands or the European Union, including content explicitly prohibited under the Dutch Penal Code (Wetboek van Strafrecht) or the EU Digital Services Act;
- scan, probe, or test the vulnerability of any system you do not own or have explicit permission to test;
- circumvent service limits or attempt to obtain Service resources beyond your plan;
- resell or re-host the Service as a competing product.
05 Fees & billing
Paid plans are billed monthly in arrears or annually in advance. Prices are listed at /pricing and are exclusive of VAT for EU customers. Invoices are issued through Stripe and payable on receipt.
06 Your data
You retain all rights to the metrics data we pull from your systems and to the chartlessops.yml configuration you provide. We do not use Customer metrics to train models, build derivative products, or otherwise benefit beyond operating the Service for you.
You grant us the minimum licence necessary to operate the Service: to pull, process, store, and display metrics data per your configuration; and to retain backups for the durations described in our Privacy Policy.
07 Availability
We target 99.9% monthly availability on Growth plans and 99.95% on Enterprise plans. Enterprise plans receive service credits per the terms in the Order Form when availability falls below the target in a given month. Maintenance windows are announced in advance and excluded from availability calculations.
08 Termination
You may cancel at any time from workspace settings. Cancellation takes effect at the end of the current billing period. Workspaces become read-only for 30 days after cancellation; configuration and historical data are exportable in that window, then deleted. We may terminate for non-payment, material breach of these Terms, or a legal requirement; we will attempt to give 14 days’ written notice where lawful.
09 Warranty disclaimer
The Service is provided “as is”. Except as expressly stated in these Terms or any Order Form, we make no warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, or non-infringement. Your statutory consumer rights under EU and Dutch law are not affected by this section.
10 Limitation of liability
Neither party will be liable for indirect, incidental, or consequential damages. Our total aggregate liability arising from or related to these Terms is limited to the amounts paid by you to us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable Dutch or EU law (including liability under Article 6:248 BW for failure to perform with reasonable care).
11 Governing law
These Terms are governed by the laws of the Netherlands (Nederlands recht). Disputes will be heard by the District Court of Amsterdam (Rechtbank Amsterdam) unless mandatory consumer-protection rules in your jurisdiction provide otherwise.
12 Changes
We may update these Terms. Material changes will be communicated by email at least 30 days before they take effect, and will be posted at this URL with a revised “last updated” date. Continued use after the effective date constitutes acceptance.
